G-DECK legal information

Terms & Conditions

These terms apply to quotations, sales, rentals, services, deliveries, and agreements supplied by LDS Hire & Sales Ltd, including inquiries and commercial activity connected with G-DECK in the United States, unless otherwise agreed in writing by an authorized representative.

General conditions

By placing an order, purchasing goods, renting equipment, requesting services, or using this website, the customer confirms acceptance of these Terms & Conditions in full.

Unless specifically agreed in writing by LDS Hire & Sales Ltd, all quotations, contracts, sales, rentals, and agreements are made strictly subject to these terms. These conditions override alternative terms the customer seeks to impose or incorporate.

Acceptance of any quotation, delivery, product, rental equipment, invoice, or service supplied by the company constitutes acceptance of these terms. Advice, recommendations, specifications, drawings, or other information are provided in good faith and do not form a legally binding guarantee unless expressly confirmed in writing.

Quotations & orders

Quotations are subject to availability, supplier pricing, manufacturing conditions, transport costs, material availability, applicable taxes, duties, and the commercial terms confirmed at the time of order.

  • Quotations are valid for the period stated on the quotation.
  • Prices may change before order confirmation.
  • Orders are not binding until accepted by the company.
  • The company may refuse or cancel an order where necessary.

Customers are responsible for confirming that order details, specifications, dimensions, quantities, delivery information, and site requirements are accurate. Changes after confirmation may result in additional charges, delays, revised lead times, or cancellation costs.

Payment terms

Payment terms are 30 days from the invoice date unless otherwise agreed in writing. Failure to pay within the agreed terms may result in suspension of current or future orders, withdrawal of credit facilities, cancellation of deliveries or services, recovery of outstanding balances, and refusal of future supply.

The company may charge interest on overdue amounts together with reasonable legal, administrative, debt recovery, or collection costs incurred in recovering unpaid balances, subject to applicable law. The company may request full or partial payment in advance for custom products, international deliveries, high-value orders, or customers without approved credit terms.

Pricing and taxes

All prices are subject to applicable taxes, duties, freight, and delivery charges. Prices may be adjusted for material increases, supplier costs, currency fluctuations, manufacturing changes, freight, delivery, government taxes, or duties. Additional charges may apply for express production, specialist packaging, additional deliveries, site access restrictions, re-delivery attempts, failed collections, and international shipments.

Retention of title

Risk in the goods passes to the customer on delivery. Legal ownership remains with LDS Hire & Sales Ltd until full payment has been received in cleared funds for all outstanding balances owed.

Until ownership transfers, goods must be properly stored and protected, insured where appropriate, and clearly identifiable as company property. If the customer enters insolvency, liquidation, administration, or breaches payment obligations, the company may recover goods and suspend deliveries or terminate contracts without liability.

Delivery

The company will make reasonable efforts to meet estimated delivery dates. Delivery dates are estimates only and are not guaranteed. The company is not liable for delays or failures caused by supplier shortages, transport delays, accidents, industrial disputes, weather, or other circumstances outside reasonable control.

Claims for damaged or short deliveries must be submitted in writing within 3 days of delivery. Non-delivery claims must be submitted within 10 days of dispatch. Additional transport or handling charges may apply for extra deliveries, failed delivery attempts, amended allocations, or repeat site visits.

Cancellation, defects & returns

Customers must inspect goods upon delivery and notify LDS Hire & Sales Ltd in writing of defects within 28 days. Where a defect is confirmed as resulting from faulty manufacture or design, the company may repair the goods, replace defective components, replace the goods, or provide an appropriate credit at its discretion.

This does not apply to damage caused by misuse, negligence, incorrect installation, unauthorized modifications, transportation damage after delivery, or normal wear and tear.

Limitation of liability

To the fullest extent permitted by law, LDS Hire & Sales Ltd is not liable for indirect or consequential losses, business interruption, loss of profits, project delays, or damage arising from misuse of products or delays caused by third parties. Nothing in these terms excludes liability where exclusion is prohibited by applicable law.
